BECKLEY – A Raleigh County man claims he was wrongfully terminated by the town of Sophia for a disability that kept him from performing job duties outside his abilities.
Jimmy Mills filed his claim in the Raleigh Circuit Court on Dec. 22 against the Town of Sophia, alleging the defendant discriminated against Mills by requiring him to work outside set job expectations, which ultimately led to termination.
According to the claim, Mills began working as a street department supervisor for the defendant on May 22, 2009, and made his pre-existing physical limitations and disabilities clear to his employer. In July 2014, the plaintiff suffered a work-related injury. Mills claims the defendant’s discrimination took place after the injury when they began to require the plaintiff to complete tasks out of his normal duties.
In addition to the discrimination charges, the claim states that during his employment, the plaintiff would voice concerns to the defendant for possible criminal conduct. Mills avers that he was terminated as a consequence of voicing those concerns, which would be a violation of West Virginia public policy. After his termination, Mills alleges he incurred lost wages, annoyance and additional fees.
Mills seeks damages in the amount justified by the evidence. He is represented by George A. Hewitt of Hewitt and Salvatore, PLLC in Fayetteville. The case has been assigned to Circuit Judge John A. Hutchison.
