Woman sues doctor over allegations that post-operative injuries were preventable

BECKLEY – A Raleigh County woman claims a doctor's negligence led to permanent injuries.

Misty Kruse filed a lawsuit Dec. 24 in Raleigh Circuit Court against Dr. Touraj Farid, claiming negligent medical care.

Kruse claims that she was not properly informed on post-operative care after a July 18, 2009, endoscopic retrograde cholangiopancreatography procedure, and later developed complications she alleges could have been avoided if Farid has properly informed her of the procedure. The complaint states that Farid did not inform her that plastic biliary stents used in the surgery were temporary and did not make arrangements to remove them. The stents were found on Dec. 27, 2013, during emergency surgery, according to the complaint.

Kruse is seeking compensatory and special damages including past, present, and future emotional and physical harm; pain and suffering; medical bills; inconvenience, anxiety; complications of undiagnosed fracture and subsequent infection; and any other damages the court seems fit. Kruse is represented by Timothy P. Lupardus of Lupardus Law Firm in Pineville. The case has been assiged to Circuit Judge John A. Hutchison.
