Medexpress Urgent Care sued over negligence claims after woman fell on ice

BECKLEY – A Raleigh County woman is suing a Beckley urgent care clinic for injuries allegedly sustained on its property.

Karen Hightower filed a lawsuit on Dec. 29 in Raleigh Circuit Court against Medexpress Urgent Care Inc., citing negligence, negligent misrepresentation and consumer protection.

Hightower claims that on Dec. 31, 2013, while walking to the Medexpress office entrance at 520 Beckley Crossing she fell on ice which had accumulated on the ground and was not cleaned up by the property owner, injuring her knee. Hightower claims that her injuries could have been prevented had the company taken appropriate measures to remove the snow and ice.

Hightower is seeking compensation for past, present, and future medical expenses, pain and suffering, mental anguish, injury, mental anguish, loss of society and emotional distress, as well as pre- and post-judgment interest, costs and attorney's fees and any other relief the court sees fit. Hightower is represented by Anthony J Sparacino. The case has been assigned to Circuit Judge H.L. Kirkpatrick III.
