Company sues Appalachian Piping Products, alleging failure to pay for goods

GLENVILLE – A Connecticut company is suing a Glenville company over claims that it never received full payment for goods delivered.

Osterman & Co. Inc. filed a suit in Gilmer Circuit Court on Dec. 24 against Appalachian Piping Products Inc., alleging breach of contract.

According to the complaint, the defendant ordered more than 40,000 pounds of high-density polyethylene (HDPE) from Osterman & Co. on Oct. 2, 2014. The plaintiff claims the piping company still owes for payment and accrued interest regarding the HDPE. After allowance for all proper credits for payments of $22,500, the plaintiff avers to still be owed a total payment of $13,010.40 plus interest.

The plaintiff seeks the remaining balance $13,010.40, an accumulating interest rate of 7 percent since Nov. 16, 2014, and attorney’s fees. It is represented by John R. Keating of Amato, Keating and Lessa P.C. of Bethlehem, Pennsylvania.
