New Martinsville couple's suit stems from highway collision

MOUNDSVILLE — A New Martinsville couple is suing numerous parties over claims of grievous injuries incurred in a traffic accident.

Charles M. Moore and Rebecca Moore filed a lawsuit on Jan. 11 in Marshall Circuit Court against the estate of Gary Scott, Denver Gibson, Glenell Gibson, Hot Rod’s Trucking LLC, Richard Gessel Trucking Inc. and Superior Tank Inc. over claims of reckless driving.

The Moores allege that on Feb. 17, 2015, as they were driving southbound on Route 2 in Glendale, Scott was driving northbound on the Route 2 extension and attempted a right-side pass of a tractor-trailer driven by Denver Gibson, who the plaintiffs claim was driving northbound on Route 2 in the left-hand passing lane and who was attempting to merge into the right-hand lane. Scott allegedly hit Gibson’s vehicle, which caused him to lose control, spin, cross over into the southbound lane and strike the plaintiffs’ vehicle.

The plaintiffs claim to have both suffered personal injuries, loss of enjoyment of life, loss of the ability to function, and to have incurred medical treatment and expenses. They also claim to have suffered the loss of all the duties and obligations of their marital relationship, including the right to consortium, society, companionship and services.

The plaintiffs are suing Denver Gibson and his wife, Glenell Gibson, plus the three companies, claiming a range of business relationships between the parties.

The Moores are suing for all damages allowed under applicable law with pre- and post-judgment interest, and all other rewards deemed just by the court. They are represented by M. Eric Frankovitch and Kevin M. Pearl from the office of Frankovitch, Anetakis, Colantonio & Simon from Weirton. The case is being heard by Judge David Hummel.
