Man claims Lowe's is responsible for his injuries suffered in parking lot.

WHEELING—A McMechen man blames Lowe’s for his fall in the parking lot of its Wheeling store and is suing the company.

William Fetty filed a lawsuit on Jan. 19 in Ohio Circuit Court against Lowe’s Home Centers LLC and John Does 1-3 over claims that the business improperly maintained its premises, causing him to fall.

Fetty alleges that while on a visit to the Lowe’s store at 2801 Chapline St. on Jan. 31, 2014, he violently fell and struck the ground in the parking lot, causing him injuries to his head, neck, shoulders, back, chest, arms, legs, knees, ankles, body chemistry and psyche. He claims to have suffered great pains and financial stress because the defendants allegedly neglected to maintain their parking lot. He asserts that it is the duty of defendants to monitor, manage and ensure that their premises are safe for the public transversing the property, and alleges that the defendants have recklessly failed to do so, endangering the public.

Fetty is suing for compensatory and general damages, pre- and post-judgment interests, attorney costs, and any other rewards deemed proper by the court. He is seeking a jury trial and is being represented by Shane M. Mallet from Mallet Law Offices in Wheeling. Judge David J. Sims is hearing the case.
