Woman claims Speedway is repsonsible for damages caused by her fall on the ice

HUNTINGTON – A Cabell County woman who allegedly slipped and fell in a parking lot is suing Speedway for damages.

Darlene Doss has filed a lawsuit Dec. 10 in Cabell Circuit Court against Speedway LLC, citing negligence.

Doss claims that on or about Dec. 12, 2013, while she was walking across the parking lot belonging to defendant, she was caused to fall to the ground due to ice and/or other foreign substance, snow and/or slippery conditions on the pavement. She claims to have fallen on her hands, knees, and face.

At time and place, Doss asserts that Speedway was under a non-delegable duty to maintain and inspect its parking for safety issues. Doss claims that defendant recklessly and negligently failed to do so, causing harm to her and potential harm to the public. Doss alleges that she has not only suffered physical pain, but mental anguish, a diminution of her capacity to enjoy life, loss of earning capacity, permanent impairment, humiliation, embarrassment, annoyance and inconvenience and medical care.

She is suing for damages, pre- and post-judgment interests, court costs, attorney fees and any other relief deemed proper by the court. She is represented by Kenneth P. Hicks of Huntington. The case is assigned to Circuit Judge Chris Chiles.
