BECKLEY — A man involved in a traffic accident is suing a driver and the Raleigh County Airport Authority, claiming he sustained permanent injuries in the incident.
Paul McDowell filed a lawsuit on Jan. 14 in Raleigh Circuit Court against Timothy McKinney and Raleigh County Airport Authority, seeking compensatory damages for bodily injuries he alleges were caused by the defendant driver's negligence, carelessness and recklessness.
The plaintiff alleges that on Jan. 21, 2014, he was a passenger in a 2010 Jeep Wrangler owned and operated by a Michael Fowler and was traveling south from the FCI Beckley prison property near the town of Beaver when McKinney, driving a 2011 Ford F-250 owned by Raleigh County Airport Authority, pulled out of Camp Road, causing Fowler's vehicle to strike McKinney's vehicle.
The plaintiff alleges that McKinney failed to yield the right of way, and the plaintiff further claims that he suffered permanent physical injuries about his extremities, mental and physical pain, anxiety and loss of the ability to enjoy life, and has incurred medical expenses amounting to $8,373, with more medical treatments coming in the future.
The plaintiff is suing for damages, attorney fees, and other rewards deemed appropriate by the court. He demands a jury trial and is represented by John F. Hussell of Wooton, Davis, Hussell & Ellis PLLC in Beckley.
