WHEELING — An Ohio County man who was pinned under a car that crashed through his apartment is suing the alleged driver.
Plaintiff Richard L. Boston, by and through his Next of Friend and Power of Attorney, Jill L. Thorngate, filed a lawsuit on Jan. 21 in Ohio Circuit Court against Robert A. Seyler over claims that the defendant was negligent and caused bodily harm.
Boston claims that on or about March 23, 2014, he was residing in his home at Brook Park Place Apartments at 1290 National Road in Wheeling when, around 5:58 pm, defendant Seyler, who was operating a 1998 Lincoln Continental sedan, recklessly and negligently failed to maintain control of his car and struck a parked vehicle before continuing to accelerate forward and crashing into Boston’s apartment.
Seyler allegedly continued to accelerate through Boston’s apartment and pinned Boston under the front end of the Lincoln. Boston claims he suffered personal injuries to his body, medical bills, physical pain, mental anguish, and loss of capacity to enjoy life and engage in normal activities.
Boston is suing for compensatory damages, pre- and post-judgment interest, costs and attorneys' fees, and any further relief deemed just by the court. He is demanding a jury trial and is represented by attorneys Justin J. Wiater and Robert J. Fitzsimmons of Fitzsimmons Law Firm PLLC in Wheeling. Judge James P. Mazzone is hearing the case.
