Disabled woman accuses federal prison where she worked of discrimination

BECKLEY — A Raleigh County couple is suing the United States of America, claiming the federal prison where the wife worked created a hostile environment based on her disability.

Heather Carter and Tommy Carter filed a lawsuit Feb. 3 in U.S. District Court for the Southern District of West Virginia at Beckley against the United States of America, alleging violations of the Americans with Disabilities Act.

According to the complaint, Heather worked for the Federal Correctional Institution in Raleigh County as an accounting technician and financial specialist between 2003 and 2015, until the harassment began. Carter claims the physical limitations imposed by her multiple sclerosis made it impossible to complete some of the tasks assigned by supervisors. The suit further states the additional requirements were placed on her to force her to retire early.

The Carters seeks a jury trial and damages in excess of $2 million, plus interest and litigation costs. They are represented by attorney Michael E. Froble of the Froble Law Firm in Beckley.
