Woman claims she was fired while seeking treatment for migraines

Termination

HUNTINGTON — A woman from Scottown, Ohio, is suing a Cabell County manufacturer of eye-care products, claiming the company unlawfully fired her.

Amanda Shoemaker filed a lawsuit on Feb. 4 in Cabell Circuit Court against Alcon Laboratories Inc., claiming she was unlawfully terminated.

Shoemaker claims that while employed as a production technician at Alcon she suffered from severe migraines which caused her to seek medical treatment. Shoemaker alleges she was terminated from her position while seeking diagnosis and treatment for her condition. She claims her termination violated the West Virginia Human Rights Act and the Family and Medical Leave Act.

Shoemaker is seeking back wages, liquidated damages, compensatory damages, reinstatement and/or front pay, court costs and reasonable attorney's fees, as well as punitive damages in an amount to be determined by a jury and pre-judgment and post-judgment interest. Shoemaker is represented by Hoyt Glazer of the Law Office of Hoyt Glazer in Huntington.
