FAYETTEVILLE — An Oak Hill man is suing a hospital and doctor, claiming his late wife's death is due to the defendants' negligence.
Bob Ball filed a lawsuit as administrator of the estate of Dolly May Ball, deceased, on Feb.16 in Fayette Circuit Court against Oak Hill Hospital Corporation doing business as Plateau Medical Center and Dr. Restituto S Ruiz Jr., claiming his wife was not given complete and consistent medical care prior to her death.
Ball claims that on Feb. 16, 2014 his wife went to the emergency department of the hospital, was diagnosed with pneumonia, and was admitted to the intensive care unit. She was dead by the late afternoon of Feb. 17, 2014, and the suit claims that while being treated, Dolly May Ball's condition continued to worsen and Ruiz and medical staff did not properly attempt to save her life. The plaintiff alleges that their negligence ultimately led to his wife's death.
The plaintiff is seeking compensatory damages for economic and non-economic losses as allowable under West Virginia law, pre-judgment and post-judgment interest, attorney's fees, damages including mental pain and suffering, sorrow, and loss of companionship.
