BECKLEY — An equipment company is suing a stone and gravel operation, claiming the defendant has failed to pay for equipment, service and parts.

Leslie Equipment Company, with shops in Beaver, West Virginia, and Pikeville, Kentucky, filed a lawsuit on Feb. 2 in Raleigh Circuit Court against Cline and Sons Stone and Gravel Inc. and company president Patrick S. Cline, claiming breach of contract.

Leslie claims equipment, services and parts were provided to the gravel company, which is located in Gilbert, West Virginia, yet the plaintiff allegedly was never paid in full and is owed $12,424.62 plus interest.

Leslie is seeking payment in full, plus contractual interest at the rate of 18 percent per annum until judgment, post-judgment interest, attorney's fees, collection costs, and any other relief the court sees fit. Leslie Equipment is represented by Jason S. Hammond of Bailey & Wyant, PLLC in Charleston, West Virginia.
