HERC Oil & Gas alleges ex-employee isn't entitled to profit-sharing benefit

WEST UNION – A Kentucky company is suing a former employee who lives in West Virginia over an alleged profit-sharing dispute. 

HERC Oil and Gas LLC. filed a lawsuit on Feb. 11 in Doddridge Circuit Court against Tamera McLaughlin seeking a declaratory judgement regarding the company's profit-sharing policy.

McLaughlin was an employee of the company and a member of the profit-sharing group, but HERC alleges that since her termination she is no longer entitled to the profit-sharing practice. The company claims McLaughlin has threatened several lawsuits against the company.

HERC is seeking an order stating that McLaughlin is not entitled to any profit-sharing privileges, that reimbursement of expenses are not "wages due" and that the company should only reimburse McLaughlin for expenses that have supporting documentation. The company goes on to request attorney's fees as well as any other relief the court deems fit. HERC is represented by Kevin L. Carr & Mitchell J.
