LOGAN — A Logan County woman is suing the City of Logan for alleged negligence, claiming she was badly injured when she tripped on a sidewalk that was in disrepair.
Barbara Brewster Cook filed the suit Feb. 22 in Logan Circuit Court, alleging that she fell on Feb. 22, 2014, due to a bad sidewalk on Main Street. The suit claims that not only is the defendant required to keep the sidewalk in repair, but it also should have known the sidewalk was not in proper condition.
As a result of the defendant's alleged negligence, according to the suit, the plaintiff sustained a broken nose, five broken teeth, a fractured patella and a concussion; required surgery; and was bedridden for several months. She has incurred large health-care expenses, and will continue to endure pain and suffering, mental anguish and loss of enjoyment of life, the suit says.
She seeks a trial by jury and judgment against the defendant in an amount to fully compensate her for her injuries, pre-judgment interest, court costs and other relief the court deems proper.
She is represented by Todd A. Mount of Shaffer & Shaffer PLLC in Madison. The case is being heard by Judge Eric H. O'Briant.
