Pizza company claims buyer defaulted on payments

BECKLEY — A pizza and grill company is suing another company for allegations of defaulting on payments to purchase assets.

Roma Pizza & Grill Inc. filed a lawsuit on Feb. 26 in Raleigh Circuit Court against Iza Inc., Rana Z. Tanveer, and Imran Fazil, citing breach of contract.

According to the complaint, on Aug. 28, 2012, the defendants entered into an agreement to purchase the business assets of Roma Pizza & Grill Inc. for a sum of $70,000, with an initial down payment of $30,000 and a promissory note for the remaining balance.

On Sept. 17, 2012, the defendant executed a promissory note stipulating the payment plan and interest rate of the remaining balance of $40,000, the suit says. The plaintiff avers that the defendants have defaulted in terms of their contractual obligation to the plaintiffs, with a total remaining balance of $10,000 plus $3,000 in late fees.

Roma Pizza & Grill Inc. seeks judgment in the amount of $13,000, plus statutory attorney’s fees. It is represented by Paul W. Roop II, in Beckley.
