HUNTINGTON – A Cabell County man is suing his former employer for allegedly firing him for taking a health-related leave of absence.
Kyle Stevens filed a lawsuit March 21 in Cabell Circuit Court against Huntington Steel and Supply Co. and an unnamed defendant, alleging violations of the West Virginia Human Rights Act.
According to the complaint, Stevens was terminated by Huntington Steel after he became disabled and requested a leave of absence under the Family and Medical Leave Act. The suit says Stevens had never been disciplined at work and he was fired for his perceived disability, in violation of the WVHRA.
Stevens seeks a jury trial and punitive and compensatory damages in an amount to be determined at trial. He is represented by attorney D. Adrian Hoosier II of Lord Hoosier PLLC in Charleston.
Judge F. Jane Hustead is assigned to the case.
