Lighting operation claims company owes $21,000

MOOREFIELD – A lighting company is suing over alleged nonpayment of a bill for items purchased by the defendant on credit.

Capital Lighting & Supply LLC, doing business as Capital Tristate, filed the suit May 13 in Hardy Circuit Court against SDW Electric LLC.


In 2013, Capital Lighting extended a credit agreement to SDW Electric for $13,000 in materials, parts and supplies, the suit says, adding that despite several attempts to collect what is owed, Capital Tristate alleges that SDW Electric has refused to pay.

Because of interest, which continues to accrue at $6.63 a day, the current amount due is $21,010, according to the complaint. In addition to the amount owed, Capital Tristate has suffered damages including costs related to payroll, overhead and home office administration, loss of profit, loss of interest on the amount due, damage to its business reputation, annoyance and inconvenience, according to the complaint.

Capital Tristate seeks repayment of the $21,010 plus post-judgment interest, attorney fees, and an amount to compensate it for the above listed damages and other relief the court deems just and appropriate. The company is represented by Mary K. Prim of Mary K. Prim PLLC in Scott Depot.
