Plaintiff claims motorist drove recklessly in Wheeling Tunnel

WHEELING – A Pennsylvania motorist is suing over injuries she allegedly suffered in the course of a motor vehicle collision.

Andrea D. Irby filed the suit May 20 in Ohio Circuit Court against James Clark and Arctic Express Inc., claiming negligence on the part of both defendants.


On June 27, 2014, Irby was driving westbound on Interstate 70 through the Wheeling Tunnel, she says, adding that at the same time, Clark was driving a tractor-trailer also westbound on Interstate 70. The suit alleges that Clark drove his vehicle from the left lane into the right lane and into the vehicle being driven by Irby. Her vehicle also hit the inside wall of the tunnel, she says.

The resulting collision necessitated that Irby seek medical treatment and incur medical expenses for the severe injuries she suffered, according to the complaint. She also experienced pain and suffering, aggravation, loss of the enjoyment of life and the ability to function, and lost wages, she alleges.

Because Clark was driving while in the employ of Arctic Express Inc., the suit brings the same count of negligence against the company, especially in its allegedly inadequate training of Clark.

In addition to a trial by jury, Irby demands judgment against the defendants for all damages allowed under the law, pre- and post-judgment interest and costs, and other relief the court deems proper.
