Plaintiff claims former employer didn't pay her on time

WHEELING – An Ohio woman is suing her former employer for allegedly not providing her final paycheck within the statutory time frame.

Belinda Whittaker filed the suit May 16 in Ohio Circuit Court against BFS Foods Inc.


Until March 22, Whittaker worked at BFS Foods' Elm Grove location, Marathon Gas Station, when she was advised she was being suspended for up to five days, the suit alleges. On March 28, her employment was terminated, she claims.

The next regular payday after Whittaker's employment ended was April 4, when she should have received her final paycheck, according to the complaint.

She did not receive it within the time dictated by law, which is a violation of the Wage Payment and Collection Act, the suit alleges.

Whittaker demands a trial by jury as well as a judgment against BFS Foods, liquidated damages, attorney fees, court costs and any other damaged deemed appropriate. She is represented by Sandra K. Law of Schrader Byrd & Companion PLLC in Wheeling.
