Man says negligence led to crash

BECKLEY — A Fayette County resident is suing Jason Scott Biere, The American Bottling Company, Dr Pepper Snapple Group and Dr Pepper / Seven Up Inc., citing alleged negligence, reckless conduct and vicarious liability.

Patrick Shawn Pino filed a complaint on May 20 in Raleigh Circuit Court against the defendants, alleging that his car was hit by a tractor-trailer.

According to the complaint, the plaintiff alleges that on July 14, 2014, he was driving a 1998 Pontiac Firebird behind Adam Loveday's Ford E350. They both properly stopped at a traffic signal, he claims, when a company truck driven by Biere struck the plaintiff's vehicle from behind, causing the caused plaintiff's vehicle to strike the Ford and suffer severe injures. The plaintiff holds the defendants responsible because Biere allegedly drove the vehicle recklessly, which resulted in the crash and injuries.

The plaintiff requests a trial by jury and seeks compensatory damages in an amount to be determined by a jury, punitive damages, pre-judgment and post-judgment interest as allowed by law, attorneys' fees, costs and expenses, and such other and further relief as the court deems just and appropriate under the circumstances. He is represented by Robert D. Cline, Jr. and Brian E. Bigelow of Farmer, Cline & Campbell PLLC in Beckley.
