BECKLEY — A professional consultant is suing Marco Resources LLC, Marsh Fork LLC and Everett Junior Cook, construction companies and business owner, citing alleged breach of contract.
Patrick M. Murphy filed a complaint on May 2 in Raleigh Circuit Court against the defendants, alleging that they violated the West Virginia Wage Payment and Collection Act.
According to the complaint, the plaintiff alleges that, in 2014, he was retained by the defendants as their professional consultant and provided services in 2014 and 2015. He was owed $200,000 but only received three payments: $10,000 (September 2015), $10,000 (November 2015) and $5,000 (December 2015). The plaintiff holds the defendants responsible because they allegedly had multiple checking accounts where the funds could have been drawn, but still failed to pay the total amount owed to plaintiff.
The plaintiff seeks declaratory judgment that the defendants are in breach of a contractual relationship, declaratory judgment that the plaintiff is owed the sum of $175,000 jointly and severally from the defendants for professional services rendered, compensation fees for attorney fees and costs, and such other relief as the court deems appropriate.
