WHEELING — A woman holding power of attorney is suing Guardian Elder Care LLC, Peterson Health Care and Rehabilitation Hospital and Diane Miller, healthcare facilities and an operator, citing alleged abuse and negligence.
Brenda Batallio, holding power of attorney for Sheila Mowder, filed a complaint on May 27 in Ohio Circuit Court against the defendants alleging that they failed to have a safe environment and properly monitor plaintiff.
According to the complaint, the plaintiff alleges that on from July 21, 2014, to Nov. 1, 2014, Mowder was under the care and supervision of the Peterson nursing facility. During her stay in the facility, plaintiff acquired serious injuries due to Peterson's poor care, neglect and abuse, the suit says. The plaintiff holds Guardian Elder Care LLC, Peterson Health Care and Rehabilitation Hospital and Diane Miller responsible because the defendants allegedly failed to hire, train and supervise competent, able, qualified caregivrs, which jeopardized the safety and health of the residents, particularly Mowder.
The plaintiff requests a trial by jury and seeks all damages allowable under West Virginia law, attorney's fees, punitive damages and such other items and relief that the Court sees fit to award. She is represented by Andrew L. Paternostro of The Bell Law Firm, PLLC in Charleston.
