WINFIELD — An industrial machinery company is suing H.M. Supply LLC, citing alleged breach of contract.
US Bearing and Power Transmission Corp. filed a complaint on May 31 in Putnam Circuit Court against H.M. Supply LLC, alleging that the limited liability company failed to settle a payment for equipment.
According to the complaint, the plaintiff alleges that in March 2015, it started supplying equipment to the defendant, with an agreement saying the plaintiff would issue invoices to the defendant and the latter would pay within 30 days of issuance. However, despite having been issued four invoices, the defendant still failed to settle the balance of $11,934.94 within the given span of time, the suit says. The plaintiff holds H.M. Supply LLC responsible because the defendant allegedly was fully aware of its dealings with the plaintiff and received invoices on four occasions, but did not pay.
The plaintiff requests a trial by jury and seeks the amount $11,934.94; costs and attorney fees; pre-judgment and post-judgment interest at the prevailing statutory rate; statutory attorney fees; and any other relief the court deems just and proper.
