Hancock County resident accused of breaching contract

NEW CUMBERLAND — A rental business is suing Sharon Michael, a Hancock County resident, citing alleged breach of contract.

Jaguar Holdings LLC filed a complaint on May 31 in Hancock Circuit Court against Michael, alleging that the defendant failed to renew a rental purchase agreement and breached the terms and conditions of the agreement.

According to the complaint, the plaintiff alleges that on April 3, 2014, Jaguar Holdings received a total of nine rental purchase agreements and security interest from the defendant. Part of the rental agreement is a "Rights to Possession" clause stating that if the lease is not renewed or if the terms are breached, the plaintiff has the right to take possession of items, unless the defendant is willing to pay the costs incurred in taking possession of the property and the attorney's fees, the suit says. However, the defendant did not renew the lease and breached the terms and conditions, the suit claims, adding that the plaintiffs are now entitled to possess the identified properties. The plaintiff holds Michael responsible because the defendant allegedly was aware of the terms and conditions stated in the rental purchase agreements, but still failed to abide by them.

The plaintiff seeks the immediate possession and control of all the personal property identified in each rental purchase agreement, and such other relief as the court deems proper. It is represented by Thomas J. Decapio of Frankovitch, Anetakis, Colantonio & Simon in Chester.
