FAYETTEVILLE — A contractual employee is suing Superior Coal Services LLC; Elite Coal Services LLC; Superior & Elite Coal Services Inc.; Kingston Mining Inc.; and Alpha Natural Resources Inc., citing alleged physical and psychological injury.
Adam Griffith filed a complaint on May 26 in Fayette Circuit Court against the defendants, alleging that they failed to guarantee the safety of the workplace, which resulted in an accident.
According to the complaint, the plaintiff alleges that on May 28, 2014, he was on his shift and going through his regular tasks when a coal hauler went over a piece of belt rail that suddenly flipped up, wen through the coal hauler's operator compartment and hit the plaintiff, which caused serious physical injury. The plaintiff holds the defendants responsible because they allegedly failed to guarantee the safety of everyone in the workplace by inspecting it for extraneous materials. Also, the defendants allegedly did not give hazard training to their employees and failed to report the incident.
The plaintiff requests a trial by jury and seeks compensatory damages; punitive and exemplary damages; civil penalties; attorney's fees and costs; pre- and post-judgment interest; and such other and further relief as justice requires.
