Man says aunt's care in nursing facility was substandard

CHARLESTON — A man holding power of attorney for his aunt is suing Riparian Investments LLC, Harper Mills LLC and Stonerise Healthcare LLC, alleging that the plaintiffs failed to provide his aunt with her rights as a nursing home resident.

Michael Redd, as power of attorney for Mary Hargrave, filed a complaint on May 9 in Kanawha Circuit Court against the defendants, alleging that they failed to properly look after and provide quality care to Hargrave while she was in the Harper Mills nursing facility.

According to the complaint, the plaintiff alleges that, on Nov. 10, 2014, Hargrave was admitted to Harper Mills for rehabilitation. However, Hargrave acquired serious injuries and suffered mental deterioration due to the negligence and abuse by the staff of the facility, the suit says. The plaintiff holds the defendants responsible because they allegedly failed to provide a safe environment for Hargrave and to ensure the necessary measures that could have prevented the setbacks in her health. Furthermore, the defendants failed to hire competent staff and/or properly train them, the suit says.

The plaintiff requests a trial by jury and seeks all damages allowable under West Virginia Law, attorneys' fees, punitive damages, and any other items and relief that the court sees fit to award.
