Man says nursing facility was negligent

CHARLESTON — A Boone County resident is suing Three Mile Curve Operations LLC, Logan Center and Genesis Healthcare LLC, claiming his mother did not receive proper care in a nursing home.

Arlie Asbury, as power of attorney for Bonnie Asbury, filed a complaint on May 9 in Kanawha Circuit Court against the defendants, alleging that they failed to properly supervise and take care of Bonnie Asbury while in their care.

According to the complaint, the plaintiff alleges that, on April 26, 2013, Bonnie Asbury was admitted to Logan Center and thereafter suffered serious physical injuries, such as deterioration of her skin and her mental condition. The plaintiff holds the defendants responsible because they allegedly failed to have a care and treatment plan to address his mother's skin condition. The defendants also failed to hire qualified staff and properly train them to be able to give their patients appropriate aid and treatment, the suit says.

The plaintiff requests a trial by jury and seeks all damages allowable under West Virginia law, attorneys' fees and punitive damages, and any other items and relief that the Court sees fit to award.
