Car dealer accused of negligence after fall

HUNTINGTON — A Lawrence County, Ohio resident is suing Dutch Miller Chevrolet Inc., a car dealer, citing alleged negligence.

Tammy Chinn filed a complaint on May 6 in Cabell Circuit Court against Dutch Miller Chevrolet Inc. alleging that the car dealer failed to guarantee the safety of its clients and employees by having a decorative rock garden with shifting rocks that caused her to stumble and break her wrist.

According to the complaint, the plaintiff alleges that, in May 14, 2014, she was trying to enter a vehicle at the defendant's place of business when the incident occurred, causing her to undergo surgery. The plaintiff holds Dutch Miller Chevrolet Inc. responsible because the defendant allegedly failed to perform its duty of care regarding its rock garden, and allegedly failed to give warning signs on this garden to make other aware of the existing condition. The defendant's employee also negligently parked the vehicle which the plaintiff was trying to enter, putting her in an unsafe position, the suit says.

The plaintiff requests a trial by jury and seeks damages against the defendant including costs of this litigation and other such relief as thes court may deem proper. She is represented by W. A. Dawson, Jr. of W. A. Dawson, Jr., Attorney at Law, P.A. in St. Augustine, Florida.
