Woman says hospital responsible for fall

CHARLESTON — A Raleigh County resident is suing Charleston Hospital Inc., Saint Francis Hospital and Thomas Health System Inc., alleging negligence that resulted in injuries.

Kim Elaine Tyree filed a complaint on May 11 in Kanawha Circuit Court against the defendants, alleging that they failed to maintain a safe walkway, resulting in a fall by the plaintiff.

According to the complaint, the plaintiff alleges that on May 12, 2014, she was on the premises of Charleston Hospital and didn't notice an uneven portion of a walkway. She claims she tripped and fell, losing consciousness and suffering knee and ankle injuries. The plaintiff holds the defendants responsible because they allegedly failed to guarantee the safe condition of the premises and make necessary repairs on the walkway. Defendants also failed to post warning signs about the uneven surface or the danger the condition could bring, the suit claims.

The plaintiff requests a trial by jury and seeks compensatory damages for past, present and future medical expenses, lost wages, loss of business and all other such loss of services in a fair and just amount to be determined by the jury at trial; general damages for past, present and future pain and suffering, mental anguish and emotional distress; punitive damages; pre-judgment and post-judgment interest; costs and attorney fees expended in this action; and any other further general or specific relief the court or the jury deems just and proper.
