Man accuses fence contractor of not paying proper wages

LOGAN — A Lincoln County resident is suing C.D. Cook & Son Construction Company Inc., a fence contractor, claiming unpaid wages.

Chad White filed a complaint on June 1 in Logan Circuit Court against C.D. Cook & Son Construction Company, Inc. alleging that the fence contractor failed to pay the hourly rate for the work or services rendered.

According to the complaint, the plaintiff alleges that in July 2015 he was employed by the defendant to work on the Route 10 Highway project in Logan County. He was supposed to receive the prevailing wage for the county where the employee performed work, he claims. Defendant owes a balance of $5,553.48 based on the Logan County labor code and has refused to pay this despite demands from plaintiff, the suit says. The plaintiff holds the defendant responsible because the defendant allegedly was supposed to be aware of the labor code for Logan County. The defendant also allegedly received several demands from plaintiff but the former opted not to answer or conform.

The plaintiff seeks $5,553.48 for owed prevailing wages; an additional $5,553.48 as a penalty for the defendant's failure to pay the plaintiff his prevailing ages; court costs and reasonable attorney fees; and such further relief as justice requires.
