PRINCETON — A transformer manufacturer is suing coal-mining business Kris Electrical Manufacturing Company Inc. and owner Harold Akers, citing alleged breach of contract.
Watts Transformer Inc. filed a complaint on June 3, in the Mercer Circuit Court against the defendants alleging that they failed to pay for the services rendered by the plaintiff.
According to the complaint, the plaintiff alleges that on Jan. 7, 2015, Watts Transformer Inc. invoiced the defendant for the sum of $5,400 for rewinding a motor that Kris uses for its business. However, the defendant has not settled the payment as of yet, the suit says. The plaintiff holds the defendants responsible because they allegedly refused to acknowledge the demands and efforts of the plaintiff with regard to settling the balance plus accrued interest.
The plaintiff requests a trial by jury and seeks the sum of $5,400; court costs; and pre- and post-judgment interest at the agreed upon rate of 1.5 percent for a total demand of $6,714.23, which sum continues to mount. The plaintiff is represented by Ward Morgan of The Law Office of Ward Morgan in Bluefield.
