Land owner sues company, unknown trucker for damages

WHEELING — An Ohio County resident is suing C.R. England Inc. and John Doe, a trucking business and unknown driver, citing alleged negligence and reckless conduct.

Charles G. Neuhardt filed a complaint on June 1 in Ohio Circuit Court against the defendants, alleging that the reckless operation of a tractor-trailer across his property caused damage to the real estate.

According to the complaint, the plaintiff alleges that on Feb. 3, his real estate was damaged by and actions of defendant John Doe. The plaintiff says he tried to locate and identify the driver of the truck who willfully, negligently and recklessly pulled across his property, and further alleges that defendant C.R. England failed to cooperate in finding the driver. The plaintiff holds the defendants responsible for damaging his property and for failing to help him identify the driver.

The plaintiff requests a trial by jury and seeks compensatory damages, punitive damages, attorney fees, litigation expenses, court costs, pre-judgment interest, and post-judgment interest in an amount that does not exceed the sum or value of $75,000. He is represented by Ronald Wm Kasserman of Kasserman Law Offices, PLLC in Wheeling.
