Man says security company violated telephone statutes

CLARKSBURG — A man is suing Alliance Security Inc., a security systems company, citing alleged violation of telephone harassment statutes.

Matthew Barger filed a complaint on June 2 in Hancock Circuit Court against Alliance Security Inc., alleging that the security systems company placed calls to the plaintiff despite having his phone registered under the Do Not Call registry.

According to the complaint, the plaintiff alleges that on Dec. 7, 2009, he registered his mobile phone with the Do Not Call registry. However, he still received calls from the defendant to ask about a home security system and continued to do so for four years, he allages. On Dec. 8, 2015, the plaintiff says he registered his new cellular phone number with the Do Not Call registry, but the defendant allegedly continued to place an overwhelming number of calls. The plaintiff holds Alliance Security Inc. responsible because the defendant allegedly used automatic telephone dialing systems to place calls to the plaintiff despite the fact that the plaintiff never requested or gave his consent to receive such calls. Furthermore, the plaintiff never gave his phone number to the defendant and the act clearly disregarded the plaintiff's right of privacy, the suit says, adding that the plaintiff repeatedly demanded for the calls to stop but the defendant ignored him.

The plaintiff seeks actual damages; statutory damages; injunctive relief from all further communications from defendant; general compensatory damages and punitive damages; and such other relief as the court shall deem proper under the circumstances.
