MORGANTOWN – A Wheeling man is suing Monongalia County Senior Citizens Inc. after he claims his employment was wrongfully terminated.

Eldon Callen was also named as a defendant in the suit.

Tom Clark was employed at MCSC beginning in June 2014 and became executive director in July 2014, according to a complaint filed June 22 in Monongalia Circuit Court.

Clark claims his employment continued until June 22, 2015, when he was wrongfully terminated from his employment.

The plaintiff threatened to take certain legal action against the West Virginia Bureau of Senior Services and its commissioner, Robert E. Roswall, all within his legal rights to do so, according to the suit.

Clark claims the defendants’ reason for terminating his employment was pre-textual as the real reason for his termination was his threat of legal action against Roswall and the bureau and Callen’s relationship with Roswall.

The defendants’ actions violated the West Virginia Human Rights Act, according to the suit.

Clark claims at Roswall’s direction, Callen orchestrated his termination in retaliation for numerous FOIA requests and other issues.

Clark is seeking compensatory damages. He is being represented by Scott H. Kaminski of Kaminski Law PLLC.
