CHARLESTON – A Clendenin company alleges it is owed for equipment repairs.

Shafer Equipment LLC filed a complaint on May 19 in the Kanawha Circuit Court against Cunningham Energy LLC and Pettey Oilfield Services Inc. alleging that they failed to comply with the terms of their agreement.

According to the complaint, the plaintiff alleges that it has suffered monetary damages for not receiving payment for the repairs and maintenance of the defendant's equipment in the amount of $13,088.68. The plaintiff holds Cunningham Energy LLC and Pettey Oilfield Service Inc. responsible because the defendants allegedly failed to pay for the repairs.

The plaintiff requests a trial by jury and seeks an order confirming the plaintiff's lien on the equipment of the defendants and authorize it to sell the equipment for the amount of the debt, and/or in the alternative, judgment against defendants in the amount of $13,088.68, pre- and post-judgment interest, costs, attorneys' fees and such other and further relief as the court deems just and proper. It is represented by Christopher S. Smith and Nicola D. Smith of Hoyer, Hoyer & Smith in Charleston. The case has been assigned to Circuit Judge Jennifer F. Bailey.
