WINFIELD — A woman is suing JP Morgan Chase & Co. a/k/a JP Morgan Chase Bank a/k/a JP Morgan a/k/a Chase Bank a/k/a Chase, a debt collector, citing alleged unfair and unconscionable collection practices.
Marcie Biggs filed a complaint on July 21 in Putnam Circuit Court against the defendant, alleging that the debt collector violated the West Virginia Consumer Credit and Protection Act and telephone harassment statutes.
According to the complaint, the plaintiff claims that she received calls and written communications from the defendant in an attempt to collect an alleged debt, causing her to be damaged, annoyed, abused and harassed. The plaintiff holds the defendant responsible because it allegedly engage in unreasonable, oppressive or abusive collection practices, continued to communicate with her after she was represented by a lawyer and failed to clearly disclose the business identity making demand for payment.
The plaintiff requests a trial by jury and seeks compensation for all damages, attorneys' fees, costs of litigation, and such other relief as the court shall deem just and proper. She is represented by Daniel Armstrong and Benjamin M. Sheridan of Klein & Sheridan LC in Hurricane.
