LOGAN — A lab technician has filed a class-action lawsuit against Acculab Inc., a former employer, citing alleged breach of duty and unpaid wages.
Thomas S. Elkins filed a complaint on Aug. 1 in Logan Circuit Court against Acculab Inc., alleging that the former employer violated the West Virginia Wage Payment and Collection Act.
According to the complaint, the plaintiff alleges that he worked for the defendant until his employment was terminated on Jan. 8, but he has not yet received all his remaining wages he was owed in full. The plaintiff holds Acculab Inc. responsible because the defendant allegedly failed to pay his wages within the time period mandated by the law.
The plaintiff requests a trial by jury and seeks compensation for damages, plus pre- and post-judgment interest, attorneys' fees and costs. He is represented by Todd S. Bailess and Rodney A. Smith of Bailess Smith PLLC in Charleston.
