PINEVILLE — A Glen Fork woman is suing a gas and convenience store operator, alleging its negligence caused her to fall and suffer injuries.

Ashley Francis filed a lawsuit Sept. 1 in Wyoming Circuit Court against Speedway LLC, alleging failure to maintain its parking area in a reasonably safe condition.

According to the complaint, on Aug. 25, 2015, Francis was in the Speedway parking area on state Route 10 near Oceana. While exiting her vehicle, the suit says, Francis stepped into a hole and fell to the pavement.

The lawsuit states the fall caused Francis to sustain injuries to her body, pain and suffering, loss of enjoyment of life, lost wages and mental anguish. The plaintiff alleges Speedway failed to warn her of the dangerous condition.

Francis seeks trial by jury, judgment to be determined by the jury, plus compensatory and punitive damages, court costs, attorney fees, pre- and post-judgment interest and all other relief deemed equitable. She is represented by attorneys L. Lee Javins of Bailey, Javins & Carter LC in Charleston, and by Mark A. Barney of Barney Law PLLC in Hurricane.
