Server accuses Bob Evans restaurant operators of discrimination

HUNTINGTON — A Cabell County woman is suing a local Bob Evans Farms restaurant operator, alleging a hostile work environment, racial discrimination and wrongful discharge.

Jocelyn Morrison filed a lawsuit Oct. 24 in Cabell Circuit Court against Bob Evans Farms LLC and Corey Pope, alleging violation of the West Virginia Human Rights Act.

According to the complaint, on Sept. 5, 2015, Morrison was unlawfully terminated from her employment at a Bob Evans Farm restaurant in Barboursville. Prior to her termination, the suit says, she was regularly and routinely subjected to discrimination and harassment based on her Filipino nationality.

The lawsuit states Morrison, who had started working at Bob Evans in 2003, continues to suffer economic and emotional damages. The plaintiff alleges the defendants failed to take prompt remedial actions to stop harassment and terminated her employment for opposing discrimination and harassment practices.

Morrison seeks trial by jury, re-employment, compensatory, general and punitive damages, pre- and post-judgment interest, costs of litigation and all other equitable relief. She is represented by attorneys Phillip Estep, Todd S. Bailess and Rodney A. Smith of Bailess Smith PLLC in Charleston.
