Housekeeper accuses Red Roof Inns of discrimination

CHARLESTON — A housekeeper is suing Red Roof Inns, a co-employee and a supervisor, alleging a hostile work environment and sexual discrimination.

Shelby P. Bender filed a lawsuit Nov. 10 in Kanawha Circuit Court against Red Roof Inns  Inc., Dale Samples and Elijah Abdul Jones, alleging failure to provide a safe work environment.

According to the complaint, due to the defendants' actions and inactions and fear for her safety, Bender was forced to resign Feb. 20, which caused her to suffer financial damages, indignity, annoyance and humiliation.

The plaintiff alleges Red Roofs Inns negligently hired a parolee, Jones, and permitted him to continue to intimidate and harass female employees. The suit says Samples failed to discipline Jones.

Bender seeks trial by jury, compensation for lost wages and benefits, plus all other damages, pre-and post-judgment interest, attorney fees, court costs and all other equitable relief. She is represented by attorneys Todd S. Bailess, Rodney A. Smith and Phillip Estep of Bailess Smith PLLC in Charleston.
