WHEELING — A West Virginia woman is suing her former employers, alleging violation of workers compensation acts in not paying the plaintiff her due wages.
Melissa Lively, individually and on behalf of all others similarly situated, filed a class action complaint Dec. 15 in Ohio Circuit Court against The Mentor Network of Boston, REM West Virginia LLC and REM Community Options LLC, alleging violation of the West Virginia Wage Payment and Collection Act.
According to the complaint, on Nov. 17, Lively was discharged from her employment at Mentor but she has not received all wages due and payable.
The plaintiff alleges the defendants failed to pay discharged employees within the time period as mandated by law.
Lively seeks a trial by jury, judgment for all damages, pre- and post-judgment interest, attorney fees and court costs. She is represented by attorneys Jonathan R. Marshall and Maigreade B.
