BECKLEY — A flagger supervisor i suing former employers, citing alleging breach of duty in violating wage laws.
Dean P. Monington, individually and on behalf of all others similarly situated filed a class action complaint Dec. 28 in Raleigh Circuit Court against AWP Inc. d/b/a Area Wide Protective and Area Wide Protective Inc., alleging they violated the West Virginia Wage Payment and Collection Act.
According to the complaint, on July 16, 2013, Monington was involuntary terminated from his employment but he did not received all the wages that he was owed in full within 72 hours. The plaintiff alleges the defendants failed to pay former discharged employees all wages within the time period mandated by law.
Monington seeks trial by jury, all damages up to $75,000 set forth in this complaint, pre- and post-judgment interest, attorney fees and costs of court. He is represented by attorneys Todd S. Bailess and Rodney A. Smith of Bailess Smith PLLC in Charleston.
