Pennsylvania company alleges mine supply business breached contract

PINEVILLE — A Pennsylvania company is suing a Cyclone mine supply business, alleging breach of contract and unjust enrichment.

ORCCO of Greesnburg, Pennsylvania, filed a complaint Dec. 28 in Wyoming Circuit Court against HMS Inc., formerly known as H & M Mine Supply Inc. alleging failure to perform contractual obligations.

According to the complaint, ORCCO sold certain goods to HMS. The suit says after all proper credits for payments and/or returned merchandise, the principal balance of $10,817 remains due and owing. 

The plaintiff alleges HMS, despite repeated demands for payment, has failed and refuses to make payments for the owed amount.

ORCCO seeks trial by jury, judgment for $10,817, plus interest, costs of court and all other equitable relief. It is represented by attorney John R. Keating of Amato Keating and Lessa PC in Bethlehem, Pennsylvania.
