Elderly client accuses lender, loan business of fraud

BECKLEY — An 87-year-old Beckley woman is suing a lender and loan business, alleging fraud and unconscionable inducement.

Alberta Little filed a complaint Jan. 3 in Raleigh Circuit Court against Citifinancial Inc. and Specialized Loan Servicing, alleging failure to provide a meaningful opportunity for the plaintiff to understand the transaction.

According to the complaint, Little, a black woman who says she is inexperienced in financial matters, has suffered economic losses, annoyance, stress and worry due to the defendants' unlawful acts. 

The plaintiff alleges the defendants induced her into a loan secured by her real property in an amount in excess of its fair market value and at a very high interest rate of more than 24 percent.

Little seeks trial by jury, civil penalties, appropriate relief, including setoff and restitution, attorney fees, costs and all other equitable relief. She is represented by attorneys Loree Stark and Dan Hedges of Mountain State Justice Inc. in Charleston.
