CHARLESTON — A Charleston resident is suing CitiFinancial, Inc., Bayview Loan Servicing, LLC and John Doe Holder, citing alleged unconscionable inducement.
Terry Cordell filed a complaint on Jan. 13 in the Kanawha Circuit Court against the defendants, alleging that they unlawfully engaged in a pattern of home equity skimming and predatory lending.
According to the complaint, Cordell alleges that as a result of defendants unlawful actions, he plaintiff suffered from worry, stress, annoyance, inconvenience and fear of losing his home. He holds CitiFinancial, Inc., Bayview Loan Servicing, LLC and John Doe Holder responsible because they allegedly persuaded and induced him into an unwise home loan based on an inflated appraisal with high interest rate.
He requests a trial by jury and seeks declaration that the loan was unenforceable, award for actual and consequential damages, plus penalties, attorney's fees, costs and such other just and equitable relief. He is represented by Daniel T. Lattanzi of Pepper & Nason in Charleston.
