Former machinist accuses motor repair facility of age discrimination

LOGAN — A skilled machinist is suing a Logan County electric motor repair business, alleging discrimination and wrongful termination.

Donad E. Jones of Logan County filed a complaint Jan. 30 in Logan Circuit Court against White Armature Works Inc., alleging violation of the West Virginia Human Rights Act.

According to the complaint, in February 2016, Jones, 74,  was laid off even after performing his duties in a satisfactory manner and meeting reasonable expectations. As a result, the suit says, Jones suffered lost wages and benefits, damages and humiliation. 

The plaintiff alleges his supervisor, Rodney Amburgey, promised him that he would be brought back when business picked up, but Jones was replaced by a younger and less-experienced worker.

Jones seeks trial by jury, all damages, including lost wages and benefits, back and front pay, all remedies afforded under the WVHRA, attorney fees and court costs and all other proper relief. He is represented by attorneys Todd S. Bailess and Rodney A. Smith of Bailess Smith PLLC in Charleston.
