Worker accuses former employer, co-employee of contract breach

MORGANTOWN — A West Virginia man is suing his former employer and co-employee, alleging breach of an employment contract.

John Woods filed a complaint Jan. 27 in Monongalia Circuit Court against Larry Oleska and Mona Supply Co. Inc., alleging they violated the West Virginia Human Rights Act and the Wage Payment and Collection Act.

According to the complaint, during Woods' employment with the defendant, he twice sustained workplace injuries was terminated from his employment in March 2016 when he tried to return to work. As a result, the suit says, Woods suffered lost wages and benefits, emotional distress, humiliation and embarrassment. 

The plaintiff alleges the defendants terminated his employment due to his disability and/or perceived disability and failed to pay him his due and remaining wages until two months after his termination.

Woods seeks trial by jury, compensatory and punitive damages, pre- and post-judgment interest, litigation costs and all other proper relief. He is represented by attorney D. Adrian Hoosier II of Lord Hoosier PLLC in Charleston.
