PRINCETON — A Mercer County woman is suing Princeton health care providers, alleging their negligence caused injuries to her daughter.
Veronica Nipper, parent and natural guardian of Melissa Nipper, filed a complaint Feb. 21 in Mercer Circuit Court against Princeton Community Hospital Association Inc., Dr. Joe Carey Ellington and Lori Ann Tucker, alleging they violated the West Virginia Medical Professional Liability Act.
According to the complaint, as a result of the defendants' negligence, Veronica Nipper delivered her daughter Melissa with a permanent injury that resulted in medical expenses, pain and suffering, lost wages and loss of companionship.
The plaintiff alleges the defendants violated the applicable standards of medical care by totally disregarding the welfare of plaintiff and her unborn child and by failing to timely deliver Melissa Nipper, despite indications of distress on the fetal heart monitoring strips.
Veronica Nipper seeks trial by jury, and seeks compensatory and punitive damages, litigation costs and expenses and all other and equitable relief. She is represented by attorney Richard D. Lindsay of Tabor Lindsay & Associates in Charleston.
