Injured motorist sues motorcycle dealer, agent after collision

BECKLEY — A driver from Naoma who was injured in a collision last year is suing a motorcycle dealer and one of its employees for negligence.

Nancy Harrison filed a complaint on Feb. 27, in the Raleigh Circuit Court against the defendants Ashworth Inc.  and its agent, Daniel Athey, alleging that they failed to exercise standard care and skill required in operating a vehicle.

According to the complaint, the plaintiff on Sept. 16, 2016, suffered serious and permanent injuries, incurred medical expenses and endured pain, suffering, mental anguish and emotional distress, which resulted from a collision with a vehicle owned by Ashworth, Athey was operating the vehicle at the time of the collision along Robert C. Byrd Drive in Beckley, the complaint says. The plaintiff holds Ashworth's Inc. and Athey responsible because the defendants allegedly failed to safely operate a vehicle and failed to be on a proper lookout for other vehicles to avoid an accident.

The plaintiff requests a trial by jury and seeks judgment against defendants in such amount as justified by the evidence. She is represented by Greg A. Hewitt of Hewitt & Salvatore PLLC in Fayetteville.
